Privacy Policy

Digioh, Inc. (“Digioh”) and its subsidiary Push Planet, LLC, collectively referred to as “Digioh”, takes privacy seriously. Please read this Privacy Policy, which describes the types of information collected by Digioh (the “Digioh Site”) and how Digioh may use that information.

Individuals who simply browse the Digioh Site (“Guests”) may be able to view products and information, request information and engage in certain services on the Digioh Site. Users of the Digioh Site who enter into a separate User Agreement with Digioh (“Customers”) may be able to engage in certain other services on or through the Digioh Site. “Users”(a referred to herein) may include Guests, Customers, and where applicable, individuals whose Personal Information is processed in connection with the Services, including through integrations with third-party data providers.

IF YOU ARE A USER, THIS PRIVACY POLICY APPLIES TO YOU. BY USING OR VIEWING OF THE DIGIOH SITE, SUCH USER ACKNOWLEDGES AND AGREES TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY.

Overview

This Privacy Policy is incorporated into and subject to the terms of Digioh’s Terms of Use, which can be viewed on the Digioh Site. This Privacy Policy covers Digioh’s treatment of personally identifiable information (“Personal Information”) and other non-personally identifiable information that Digioh gathers when a User accesses the Digioh Site and when a User or Customer registers to receive services from Digioh (the “Services”). By visiting the Digioh Site or using the Services, each User expressly acknowledges that such User accepts the practices and policies outlined in this Privacy Policy and consents to Digioh’s use and disclosure of such User’s Personal Information in the manner described in this Privacy Policy. If a User does not agree to the terms of this Privacy Policy, such User should not use the Digioh Site or the Services. Information Digioh Collects

If a User chooses to use the Digioh Site or the Services, Digioh may require such User to provide contact and identity information, billing information, and other Personal Information as indicated on the Digioh Site. Once a User registers on the Digioh Site, such User is no longer anonymous to us. The information that we gather from a User through the Digioh Site enables Digioh to provide, maintain and improve the Digioh Site and the Services, personalize User’s experience on the Digioh Site, process User’s requests, and process the requests of others, and includes the following information:

  1. Personal Information that such User provides to Digioh or otherwise disclose or post in connection with the Digioh Site or the Services, including the following:
    1. User’s name, address, email address, and other basic contact information;
    2. User’s preferences, content, mobile device information, and credit card information;
    3. Discussion board posts, including photographs, videos and other content; and
    4. Communications and other messages, including correspondence between Digioh and such User.
  2. Non-personally identifiable information that Digioh gathers on the Digioh Site, including User’s IP address(es), computer sign-on data, statistics on page views, traffic to and from the Digioh Site and individual pages on the Digioh Site and data that Digioh may collect through cookies or other means. A User can take steps to disable cookies on User’s browser; however, this may affect User’s ability to use the Digioh Site.
  3. General information regarding the products and services offered by such Customer.
  4. General information regarding the Services a Customer has registered to receive.
  5. If a Customer chooses to connect its Digioh account to a supported third-party advertising platform, such as Meta, Digioh may collect and process information received from that connected platform, including advertising account information, campaign information, audience information, campaign performance metrics, and other information necessary to provide the features enabled by the Customer.
  6. Depending on the Services a Customer elects to use, Digioh may receive and process Personal Information from authorized third-party data providers in connection with the Services elected by the applicable Customer.

Our Use of Customer’s Information

Digioh may use User’s Personal Information to:

  1. Provide the Services and products;
  2. Provide integrations with third-party advertising platforms, including audience synchronization, Custom Audiences, Lookalike Audiences, conversion measurement, attribution, campaign reporting, campaign optimization, and other features enabled by the Customer;
  3. Dispute, calculate and collect fees, and troubleshoot problems;
  4. Verify User’s identity and the information users provide;
  5. Encourage a safe online experience and enforce our policies;
  6. Customize users’ experience, analyze usage of the Digioh Site, improve and measure interest in our Services, and inform users about Services, products and updates;
  7. Provide Users with information that may affect their use of the Digioh Site, the Services and products;
  8. Communicate marketing and promotional offers for our own products to our users;
  9. Provide customer service.

During the course of operating Digioh’s business, Digioh may use Users’ Personal Information to deliver information to Users that may be targeted to Users’ interests. Upon receipt of the first communication of this type, a User will have the opportunity to opt-out of future communications by clicking on unsubscribe link or by following unsubscribe instructions described within the communication. If a User does not want to receive email or other communications from Digioh, such User can also contact Digioh at privacy@digioh.com. However, as part of a Customer’s registration for the Services, such Customer may receive certain communications from Digioh, such as administrative announcements and customer service messages regarding the Services and products, and Customer will not be able to opt out of receiving such communications.

From time to time, Digioh may implement solutions designed to more efficiently capture a User’s communications preferences. In any such event, Digioh will attempt to reflect any previously stated communicated preferences within such solutions.

Digioh uses Google user data to provide a “Sign in with Google” experience to our customers. The verified email address of the Google user is the only user data that is used and is only used for sign in purposes. This data is not stored by Digioh and is only used during the sign in procedure.

Digioh’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Our Sharing of Customer’s Information

Digioh does not sell or rent for commercial gain Users’ Personal Information to third parties. Digioh may share and Users hereby consent to our sharing of personal information with the following persons or entities:

  1. Corporate affiliates of Digioh to help coordinate the Services or products we provide to Users, enforce our Terms of Use and other agreements, including the User Agreement with Customer (if any), and to promote trust and safety.
  2. Service providers and others who help with our business operations and assist in the delivery of the Services and other products to our Users. Examples include, but are not limited to, the following: maintaining servers, sending email, removing repetitive information from user lists, analyzing data, processing payments, and providing customer service. Unless we tell Users differently, such service providers and other companies and people do not have any right to use Personal Information we share with them beyond what is necessary to assist us.
  3. Third-Party Advertising Platforms. If a Customer chooses to connect its Digioh account to a supported third-party advertising platform, such as Meta, Digioh may, at the Customer’s direction, transmit customer information and identifiers collected through the Services to such platforms for purposes including audience synchronization, Custom Audiences, Lookalike Audiences, conversion measurement, attribution, campaign reporting, campaign optimization, and other features enabled by the Customer. Where supported by the applicable platform, identifiers such as email addresses are transmitted using industry-standard hashing or other privacy-enhancing methods before transmission. Digioh processes this information solely on behalf of the Customer and according to the Customer’s instructions. Digioh does not use this information for Digioh’s own advertising or marketing purposes, combine advertising data across Customers, or sell customer advertising data.
  4. Disconnecting Advertising Platform Integrations. A Customer may disconnect a third-party advertising platform integration at any time through the Digioh application or, where applicable, through the advertising platform’s account settings. Upon disconnection, Digioh will revoke the integration and securely delete any stored access tokens associated with the connection within a reasonable period, except where retention is required for security, auditing, fraud prevention, or compliance with applicable law. After disconnection, Digioh will no longer access or retrieve new information from the disconnected advertising platform unless the Customer reconnects the integration. Disconnection does not delete or modify information that was previously transmitted to the advertising platform prior to the integration being disconnected.
  5. Each Customer is responsible for providing all legally required notices and obtaining all legally required permissions and consents before directing Digioh to transmit customer information or identifiers to a third-party advertising platform. Each Customer is also responsible for complying with the applicable advertising platform’s terms, policies, and applicable laws governing the use of customer data.
  6. Third parties where necessary to comply with lawful requests by public authorities, including where necessary to meet national security or law enforcement requirements. We also may share Personal Information when necessary to enforce or apply our conditions of use and other agreements, or to protect the rights, property or safety of Digioh, our employees, our Users or others. This may include exchanging information with other companies and organizations for fraud protection and credit risk reduction.
  7. Entities who acquire Digioh or its assets. In some cases, we may choose to buy or sell assets. In these types of transactions, User information, including Users’ Personal Information, is typically one of the business assets that are transferred. Moreover, if Digioh, all or its assets or the Digioh Site are acquired, or in the unlikely event that Digioh goes out of business or enters bankruptcy, User information, including Users’ Personal Information, would be one of the assets that is transferred to or acquired by a third party. Users acknowledge that such transfers may occur, and that any acquirer of Digioh, its assets or the Digioh Site may continue to use Users’ Personal Information as set forth in this Privacy Policy.

Third Party Websites

Emails from Digioh or its business partners, and the Digioh Site itself, may contain links to other Internet websites, including sites that may or may not be owned or operated by Digioh. Unless otherwise explicitly stated, Digioh is not responsible for the privacy practices or the content of such websites, including such sites’ use of any information collected when email recipients or the Digioh Site’s visitors click through links to those sites. If a User visits such websites, Digioh encourages such Users to become familiar with the privacy practices and any terms of use of such sites.

Choices for Accessing, Reviewing, and Changing User’s Personal Information

If a User is registered to receive Digioh Services, such User can access, review, modify, and delete User’s Personal Information at any time by logging into such User’s account on the Digioh Site and accessing the User profile. For Personal Information that Digioh stores about Users that is not visible on the Digioh Site, Users may contact Digioh at privacy@digioh.com or to request access to, modification of, or deletion of such Personal Information.

In general, Digioh uses Personal Information only for the purpose of providing service to Users. On request to privacy@digioh.com, we will inform Users as to how their Personal Information has been used and the specific third parties to which it has been shared. However, we cannot always delete or limit the sharing of Personal Information without impacting our ability to provide Digioh Services to Users. If Digioh cannot fulfil a User request to delete or limit the sharing of Personal Information, Digioh will offer cancellation of Digioh Services and deletion of all Personal Information with no penalty.

Digioh may delete Personal Information when Digioh determines that it no longer needs it. Additionally, Digioh may retain Personal Information as permitted or required by law to resolve disputes, enforce our policies, and help prevent bad actors from using the Digioh Site.

Policy Toward Children

Digioh is concerned about the safety and privacy of children who use the Internet. Consistent with the Children’s Online Privacy Protection Act of 1998, Digioh will never knowingly request Personal Information from anyone less than 18 years of age without prior verifiable parental consent. If a person becomes aware that its child under 18 years of age has provided Digioh with Personal Information without prior verifiable parental consent, please contact us at privacy@digioh.com and Digioh will use commercially reasonable efforts to promptly remove such information from our files.

Notification of Changes

We may amend this Privacy Policy at any time by posting the amended terms on the Digioh Site. In the event of amendment, all terms shall become effective on all Users immediately upon posting to the Digioh Site.

Data Privacy Framework

Digioh complies with the E.U-U.S. Data Privacy Framework Program and the Swiss-U.S. Data Privacy Framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union and Switzerland to the United States. Digioh has certified the Department of Commerce that it adheres to the Data Privacy Framework Program principles and governance.

In compliance with the Data Privacy Framework Program, Digioh commits to resolve complaints about our collection or use of your personal information. European Union or Swiss individuals with inquiries or complaints regarding our Data Privacy Framework Program policy should first contact Digioh at: privacy@digioh.com.

Digioh has further committed to refer unresolved Data Privacy Framework Program complaints to JAMS, an alternative dispute resolution provider located in the United States and internationally. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit JAMS at https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.

With respect to the sharing of Users’ Personal Information to third party agents, and in the event of damage, Digioh shall remain liable under the Data Privacy Framework Program principles if its agent processes such Personal Information in a manner inconsistent with Data Privacy Framework Program, unless Digioh proves that it is not responsible for the event giving rise to damage.

The Federal Trade Commission has jurisdiction over Digioh’s compliance with the Data Privacy Framework Program.

Any individual has the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Data Privacy Framework Program compliance not resolved by any of the other Data Privacy Framework Program mechanisms. Additional information is available here.
